Terms & Conditions for Iskra z Polski + Scintilla de Polonia + Spark from Poland

Welcome to the website of Iskra z Polski + Scintilla de Polonia + Spark from Poland (the "Site"). It is operated by the ICONNEL Catholic Foundation Inc. (referred to as "ICONNEL," "we," "us," or "our"). These Terms & Conditions ("Terms") explain the rules for your use of the Site, including its content, resources, and any products we offer. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms include our Privacy Policy as part of the agreement. We may update these Terms from time to time, and changes go into effect when we post them. If you keep using the Site after changes, that means you accept them.

1. Using the Site

  • Who Can Use It: You must be at least 18 years old or the legal age in your area to use the Site. By using it, you confirm you meet this requirement.

  • Allowed Uses: The Site shares information about Benedictine monastic traditions, prayer practices, and items for personal spiritual use, such as liturgical wafers, communion hosts, Christmas opłatki, rosaries, embroidered items, paintings, and sculptures. You can use it only for personal, non-business purposes.

  • What You Can't Do: You agree not to:

    • Use the Site for anything illegal or against New York or federal laws.

    • Post or share harmful, offensive, or copyrighted material (though we don't currently allow user posts).

    • Try to access parts of the Site without permission, disrupt it, or spread viruses or malware.

    • Copy, sell, or distribute our content without our written permission.

  • Availability: We try to keep the Site running, but we can't guarantee it will always be available. We can stop or limit access at any time without notice, and we aren't responsible for normal downtime under New York law.

2. Products and Services

  • What We Offer: Our products come from monastic work and include prayerfully made wafers for sacraments and holidays, plus handmade items like rosaries and sculptures. Sales help support our non-profit mission to preserve Polish Catholic culture through community, education, and care. Purchases count as unrelated business income; see our IRS Form 990 for details (request it at info@iconnel.org).

  • Ordering and Payment: You can buy items using PayPal, Visa, Mastercard, checks, or money orders. Prices are in U.S. dollars (USD) and do not include taxes or shipping. We'll add New York State sales tax at checkout if required by law. We can't always guarantee stock, and we follow New York rules against misleading sales.

  • Shipping: Items ship from 1120 Avenue of the Americas, FL4, New York, NY 10036. Shipping times depend on the carrier, and we're not responsible for delays they cause, as long as we act reasonably under New York standards.

  • Returns: Because these are sacred, handmade items, all sales are final and non-refundable. This is clearly stated to meet New York consumer protection laws. If there's a defect, contact us within 14 days at info@iconnel.org or 800-915-4266 for a replacement. We'll follow New York warranty rules where they apply.

  • Important Notes: These items are for spiritual use only. We don't guarantee any spiritual results, fit for church rituals, or health benefits—talk to your religious leader. They're not medical products, and we avoid false claims under New York advertising laws.

3. Intellectual Property

  • All Site content—like text, images, stories about monastic life, and designs—belongs to us or our partners and is protected by copyright, trademark, and other laws in New York and the U.S.

  • You can't copy, change, or share it without our written okay. You can view it for your own personal reflection.

  • Our trademarks, like "Iskra z Polski," "Scintilla de Polonia," and "Spark from Poland," can't be used without permission.

4. Your Behavior and Our Data Practices

  • Right now, the Site doesn't have user accounts, forums, or ways to submit content. If we add them later, the same rules will apply, including New York accessibility standards if required.

  • We don't collect or sell your personal information. If you give us your email, we may use it to send shipping updates, occasional newsletters about our faith-based work, or info on new items—all to support our mission. 5. Disclaimers and Limits on Liability

  • As Is: We provide the Site and products "as is," without any guarantees about accuracy, completeness, or fitness for your needs, as allowed by New York commercial laws. We hope it inspires you spiritually.

  • Spiritual Content: Info on monastic life, prayers, and requests for intercession is for your personal prayer only—not professional religious advice.

  • No Extra Liability: Under New York law, we're not responsible for indirect, special, or big damages from using the Site or buying products, even if we knew about the risk. Our total responsibility won't exceed what you paid for the item.

  • Your Responsibility: You'll cover any claims against us caused by your misuse of the Site, following New York rules on this.

6. Governing Law and Disputes

  • These Terms are governed by Delaware law, without considering conflict rules. But New York consumer protection laws still apply where required, and our choice of Delaware is fair and enforceable under New York court decisions.

  • If there's a problem, first try to resolve it informally by emailing info@iconnel.org. If not, disputes go to Delaware courts. New York residents can use small claims court for claims up to $5,000 if eligible.

  • If Part Is Invalid: If any part of these Terms is ruled invalid, the rest still applies.

  • Full Agreement: These Terms are the complete deal between us—no other promises count.

We welcome voluntary donations through the Site to support our work preserving Polish Catholic heritage, as described at https://www.iconnel.org/about-us—building community, spiritual growth, and care based on St. John Paul II's Personalism, where every person is valued as God's greatest gift. Donations are tax-deductible under federal and New York tax laws to the extent allowed.
